Terms of Service
Last updated: September 9, 2026
Welcome to Who's On Today (the "Service"), a scheduling, time clock, timesheet, and team-management application operated by Who's On Today ("we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of our website, applications, and related services. By creating an account, or by accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
Important: Hours, Timesheets & Payroll Responsibility
Who's On Today provides tools to help you record, schedule, and total employee hours. However, you — not Who's On Today — are solely responsible for the accuracy of all hours, timesheets, and pay. We are not responsible or liable for any miscalculation, error, rounding, omission, or discrepancy in recorded time, totaled hours, overtime, breaks, wages, or any figure produced by or exported from the Service.
Before using timesheets or any hour totals to pay your employees, you must do your own due diligence and independently verify that every hour, shift, break, overtime amount, and pay figure is correct. Always review and confirm the numbers yourself. The Service is an aid and does not replace your own review, your payroll provider, your accountant, or your obligation to comply with all applicable wage, hour, overtime, and labor laws.
1. Who May Use the Service
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business or organization, you represent that you are authorized to accept these Terms on its behalf, and "you" includes that organization.
2. Accounts & Security
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials and any employee PINs or kiosk codes, and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. You are responsible for ensuring that the people you invite, and the roles and permissions you assign to them, are appropriate for your business.
3. Description of the Service
The Service offers features that may include time clock and kiosk clock-in, scheduling, timesheets and exports, time-off and coverage requests, staff and department management, roles and permissions, recognition tools, team messaging, and related reporting. Features may be added, changed, or removed over time. Some features are optional and may be enabled or disabled by an account administrator.
4. Your Responsibilities & Acceptable Use
You agree that you will:
- Provide accurate account and business information and keep it up to date.
- Use the Service only for lawful purposes and in compliance with all applicable laws, including wage-and-hour, overtime, break, recordkeeping, and privacy laws.
- Obtain any consents required to record and manage your employees' time and information.
- Independently verify hours, timesheets, and pay before relying on them (see the highlighted notice above).
You agree that you will not:
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its data.
- Upload unlawful, infringing, or harmful content, or use the Service to harass or harm others.
- Resell or provide access to the Service to third parties except as permitted by your plan.
5. Subscriptions, Fees & Billing
Certain features and plans are offered on a paid subscription basis. Fees, billing cycles, and plan details are presented at the time of purchase. Unless stated otherwise, subscriptions renew automatically for the same period until cancelled, and fees are non-refundable except where required by law. You authorize us and our payment processor to charge the payment method on file. We may change pricing on a going-forward basis with reasonable notice. You are responsible for any applicable taxes.
6. Your Data
You retain ownership of the data you and your team enter into the Service ("Your Data"), including schedules, time records, and staff information. You grant us the limited right to host, process, and use Your Data as needed to provide and improve the Service. You are responsible for the accuracy and legality of Your Data and for keeping your own copies of any records you are required to retain. We take reasonable measures to protect Your Data but cannot guarantee absolute security.
7. Third-Party Services
The Service may rely on or integrate with third-party services (for example, payment processing or email delivery). Your use of those services may be subject to their own terms, and we are not responsible for third-party services or their availability.
8. Intellectual Property
The Service, including its software, design, and content (excluding Your Data), is owned by us and our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, or create derivative works of the Service except as expressly permitted.
9. Service Availability & Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any data, calculation, or output will be accurate or complete. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, Who's On Today and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, wages, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service — including, without limitation, any damages resulting from errors or miscalculations in hours, timesheets, wages, or pay. Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Who's On Today and its owners, employees, and suppliers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, Your Data, your payment of employees, or your violation of these Terms or of any applicable law.
12. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
14. Contact Us
